1. Introduction & Acceptance
These Premium Plans – Terms of Use (“Premium Terms”) govern the purchase and use of paid or subscription-based features (“Premium Plans”) offered on the HappinessCue® platform.
Premium Plans may be available to:
- Clients (service seekers), and/or
- Experts (service providers)
By purchasing or activating any Premium Plan, you confirm that:
- You have read and understood these Premium Terms
- You agree to be legally bound by them
- You also agree to the Website Terms of Use, Disclaimer, Privacy Policy, Client Agreement or Expert Agreement (as applicable), and Payment, Cancellation & Refund Policy
If you do not agree, you must not purchase or use Premium Plans.
2. Nature of Premium Plans
Premium Plans provide enhanced platform features, which may include (illustrative only):
For Clients:
- Priority or advanced booking options
- Access to additional tools, content, or resources
- Platform-level convenience features
- Exclusive or early-access functionalities
For Experts:
- Enhanced profile visibility or discoverability
- Access to advanced dashboards or analytics
- Promotional or branding features
- Priority platform support
⚠️ Premium Plans do NOT guarantee:
- Better advice or outcomes
- Faster resolution of issues
- Higher earnings for Experts
- Increased session bookings
- Preferred treatment in disputes
3. Subscription, Duration & Activation
- Premium Plans are activated only after successful payment
- Plan duration and features are clearly displayed before purchase
- Premium access remains active until:
- Plan expiry, or
- Termination due to policy violations
Auto-renewal, if offered, will be clearly disclosed at the time of purchase.
4. Payments & Refunds
- All payments for Premium Plans are governed by the Payment, Cancellation & Refund Policy
- Unless explicitly stated otherwise:
- Premium Plan fees are non-refundable
- No partial refunds are provided for unused periods or features
- Early cancellation does not entitle users to a refund
Users are encouraged to review plan details carefully before purchasing.
5. Feature Availability & Modifications
HappinessCue reserves the right to:
- Add, modify, suspend, or discontinue Premium features
- Upgrade or restructure Premium Plans
- Introduce new plans or pricing models
Such changes may occur due to:
- Platform improvements
- Technical constraints
- Regulatory or compliance requirements
Discontinuation or modification of features does not entitle users to refunds, provided core platform access remains available.
6. Responsible Use & Restrictions
Premium users must:
- Use features in compliance with platform policies
- Avoid misuse, manipulation, or unfair advantage
- Not share Premium access with other accounts
HappinessCue may suspend or revoke Premium access (without refund) if:
- There is misuse or abuse of features
- Platform rules are violated
- Fraudulent or misleading activity is detected
7. Support for Premium Users
Premium users may receive:
- Priority or dedicated support channels (where offered)
However:
- Response time is not guaranteed
- Support does not include personal counselling, legal, or technical consultancy
8. Limitation of Liability
To the maximum extent permitted by law:
- HappinessCue is not liable for losses arising from Premium feature usage
- No guarantee is made regarding performance, visibility, or results
- Platform availability remains subject to technical limitations
Premium Plans do not override or dilute the Disclaimer or Limitation of Liability clauses in other platform policies.
9. Suspension & Termination
HappinessCue reserves the right to:
- Suspend or terminate Premium Plans without notice
- Disable features in case of violations
Termination due to policy breaches does not entitle users to refunds.
10. Governing Law & Jurisdiction
These Premium Terms are governed by the laws of India.
All disputes shall be subject to the exclusive jurisdiction of courts in Gurgaon, Haryana.
11. Updates & Acceptance
HappinessCue may revise these Premium Terms at any time.
Continued use of Premium features after updates constitutes acceptance of the revised terms.
